What Does “Mediation” Mean?

In basic terms, mediation is a voluntary and confidential method of resolving a dispute with the help of a neutral third party, called a mediator. It allows you to avoid having to go to court. What Does “Saturday Mediation Service” Mean?

At Mountain & Valley Law Firm, we offer Saturday mediation services. That way, you’ll have the option to schedule a mediation on a Saturday. For these services, we offer flat-fee pricing, which includes our preparation time. Contact our office to further discuss our flat-rate fees.

What is not included is legal advice from our mediators. Mediators are neutral parties and cannot act as any party’s private attorney. They cannot give specific legal advice, even though they’re lawyers by trade. If you need legal representation during your mediation session, you must hire your own attorney.

Also, court filing fees are typically not included in your Saturday mediation services cost (unless explicitly stated in our agreement). You’re responsible for any filing costs after your agreement is signed. Confidentiality and the Mediation Privilege in Montana

Montana’s mediation privilege is among the strongest protections available in the dispute resolution process. Under Montana Code Annotated 26-1-813, all mediation-related communications – verbal or written – between the parties or from the parties to the mediator are confidential. The mediator’s report and any information or recommendations are not admissible as evidence in any subsequent court action and are not subject to discovery or subpoena. The parties and the mediator are also protected from being compelled to testify about what occurred in the session.

This means that what you say in mediation generally cannot be used against you if the mediation does not result in an agreement and the matter proceeds to court. This protection gives both parties the freedom to speak openly and explore creative solutions without fear that candid statements will later be weaponized.

There are three narrow exceptions where the mediation privilege does not apply under MCA 26-1-813(5): 

  1. When disclosure is required by a separate Montana statute; 
  2. When all parties and the mediator agree in writing to allow disclosure – either before, during, or after the mediation; 
  3. When the mediator needs to establish a claim or defense in a dispute between the mediator and a party. 

Outside these limited circumstances, the privilege holds.

For family law matters, Montana law provides an additional, parallel layer of confidentiality, specifying that all records of a mediation proceeding are confidential and may not be used in evidence.
