What Does “Mediation” Mean?

In basic terms, mediation is a voluntary and confidential method of resolving a dispute with the help of a neutral third party, called a mediator. It allows you to avoid having to go to court. Unlike a judge in a courtroom, the mediator does not take sides or decide who is “right.” The mediator facilitates an informal conversation so the parties can reach their own mutually acceptable agreement. It can be a more efficient, more cost-effective alternative to court.

What Types of Cases Does Mountain & Valley Law Firm Handle?

According to data from the U.S. Census, Bozeman has 23,970 households, including 8,731 married-couple households. When last studied, the CDC reports that the divorce rate in Montana is 2.3 for every 1,000 people living in our state. This means that there’s a significant population in our region who may need mediation services at some point in the near future. If you do, reach out to us.

At Mountain & Valley Law Firm, our firm understands the specifics of Montana family dynamics. We know the community, the local data, and that mediation is often the most efficient way to navigate complicated cases. Our mediators resolve many types of conflicts, including:

  • Family law mediations
  • Civil litigation mediations

If you believe we’d be a good fit for your mediation, please talk to our team to set up a mediation consultation at a time that’s convenient for your schedule.

What Is the Mediation Process Like at Mountain & Valley Law Firm?

When you partner with Mountain & Valley Law Firm, you can expect a disciplined and structured approach. We are fully compliant with current Montana mediation laws. Our process includes:

  • A strategic initial consultation. We start by listening to the unique challenges you’ve been facing and outlining how our mediation framework can be applied. This lets us tailor the process to your specific legal and practical objectives, right from the start.
  • Meticulous preparation. True to our “no-shortcuts” philosophy, we assist all participating parties in identifying and gathering the essential information necessary for a productive mediation dialogue. By confirming that everyone is fully prepared, we can set up for more efficient and successful negotiations. This also keeps costs to a minimum, which parties historically appreciate.
  • Facilitated mediation sessions. Our mediators act as neutral guides, steering the conversation toward constructive outcomes. We use proven communication techniques so that every party is heard. We push past traditional obstacles to discover mutually beneficial solutions.
  • The caucus method. To facilitate open and honest mediation communication, we use private caucuses. This means we separate parties into separate rooms. We can meet in person at our Bozeman office or via secure virtual sessions. That way, we can hold confidential discussions to explore resolution methods that might not necessarily surface in a face-to-face setting.
  • Formal agreement documentation. Once a consensus is reached, we document every term. That way, the final agreement can be legally enforceable and serve as a definitive outline for the future. By helping you create your own resolution, we can reach an outcome that all parties are committed to upholding.

If you have more questions about the mediation process at Mountain & Valley Law Firm, please contact us. We’re more than happy to answer your questions.

What Does “Saturday Mediation Service” Mean?

At Mountain & Valley Law Firm, we offer Saturday mediation services. That way, you’ll have the option to schedule a mediation on a Saturday. For these services, we offer flat-fee pricing, which includes our preparation time. Contact our office to further discuss our flat-rate fees.

What is not included is legal advice from our mediators. Mediators are neutral parties and cannot act as any party’s private attorney. They cannot give specific legal advice, even though they’re lawyers by trade. If you need legal representation during your mediation session, you must hire your own attorney.

Also, court filing fees are typically not included in your Saturday mediation services cost (unless explicitly stated in our agreement). You’re responsible for any filing costs after your agreement is signed. Please contact our office if you have any additional questions about what’s included (or not included) in our mediation services.

Why Should I Consider Saturday Mediation Services?

There are many benefits to choosing mediation, especially Saturday services. Some advantages include:

  • Avoid missing work. Court cases tend to take time, and mediation is designed to keep you from having to miss work. Sometimes, having to take time away from work (often without pay) is a hassle. When you choose to participate in mediation, it’s beneficial for everyone involved. Whether you work Downtown or near MSU, mediation can keep you from having to take days off.
  • Convenience. Mediation often allows you to conduct sessions either in-person or from virtual platforms, such as Zoom or Google Meet, for added convenience.
  • Confidentiality and speed. Unlike court proceedings, mediation is private. Most of what’s said in mediation can’t be used negatively against you in court if the mediation process fails. Also, mediation generally resolves legal disputes in days or weeks instead of months or years.
  • Child-centric focus. Since many of our Montana households have children, when parties participate in the process, it often results in better compliance with the agreements and less conflict in the future
  • Maintain control. Parties can control the outcome of a mediation, rather than leaving personal decisions to a judge.
  • Cost-effective. Instead of having to pay attorneys for a lengthy period of time, you can more effectively control the costs of your dispute by paying your attorney and a mediator for a set timeframe. Many parties find that the mediation process is more cost-effective than going to court. Mediation is typically much less expensive than hiring attorneys for a full court battle.
  • Preserves relationships. The goal of mediation is to preserve your working or personal relationships. Often, litigation destroys them through an adversarial process.
  • Less stress. Mediation is usually a less confrontational process when compared to courtroom litigation. Also, you can control the outcome and participate in creating your plan for your future when you sign up for mediation.

To take advantage of these benefits, contact Mountain & Valley Law Firm.

We find this to be an effective method that creates “buy-in” among the parties, both currently and in the future.
